Case Summaries 2022-2023

REGULATION 1- [Disturbance of the Peace] The infringement upon the right to privacy of any member of the community is prohibited.  Disorderly and disruptive conduct and/or the persistent disturbance of a reasonable level of peace and quiet is also a violation.

In a simplified hearing, the board considered allegations that Student A and B violated Section II, Regulation 1 and 14 of the Wesleyan University Code of Non-Academic Conduct.  The board found Student A not responsible.  Student B was found responsible and sanctioned with a disciplinary warning. 

In a simplified hearing, the board considered allegations that Students A, B and C violated Section II, Regulation(s) 1, 4 and 14 of the Wesleyan University Code of Non-Academic Conduct.  Student A was found responsible for violating Regulation 1 and 4, but not Regulation 14.  Student A received a disciplinary warning.   Student B was found responsible for violating Regulation 4, but not for Regulation(s) 1 and 14.  Student B received a disciplinary warning.  Student C was found not responsible for any of the alleged violations. 

In a simplified hearing, the board considered allegations that this student violated Regulations 1, 4 and 14 of the Wesleyan University Code of Non-Academic Conduct.  The board found the student not responsible for any of the violations. 

In a full hearing, the board considered allegations that students violated Section II, Regulations 1, 4, 8 and 15 of the Wesleyan University Code of Non-academic Conduct.  The students were found responsible for violating Regulation 8 and 15, but not responsible for Regulation 1 or 4.  The students received a disciplinary warning.

In a simplified hearing, the board considered allegations that a student violated Regulations 1, 14 and 15 of the Wesleyan University Code of Non-Academic Conduct.  The board found the student not responsible for any of the violations.

In a full hearing, the board considered allegations that a student violated Regulations 1, 2, 13b and 14 of the Wesleyan University Code of Non-Academic Conduct.  The student was found responsible for violating Regulation 1, 2, 13b and 14.  The student was sanctioned with disciplinary probation and a recommended session with CAPS. 

In a simplified hearing, the board considered allegations that Students A, B, C and D violated Regulations 1, 13b, 13c and 15 of the Wesleyan University Code of Non-Academic Conduct.  Student A, B and C were found not responsible for violating Regulations 1, 13b, 13c or 15.  Student D was found responsible for violating Regulations 13b and 14, but not responsible for 13c or 15.  Student D was sanctioned with a disciplinary warning and an online educational assignment.  

In a simplified hearing, the board considered allegations that students violated Regulations 1 and 14 of the Wesleyan University Code of Non-academic conduct.  All of the students were found not responsible for any of the violations. 

In a simplified hearing, the board considered allegations that students violated Regulation 1 and 13b of the Wesleyan University Code of Non-Academic Conduct.  The students were found responsible for violating Regulation 13b, but not for Regulation 1.  The students received a disciplinary warning.

In a simplified hearing, the board considered allegations that Students A, B and C violated Regulation 1 of the Code of Non-Academic Conduct.  All students were found responsible and were sanctioned with a disciplinary warning. 

In a simplified hearing, the board considered allegations that Students A and B violated Regulations 1, 13C, 13B, and 15 of the Wesleyan University Code of Non-Academic Conduct.  The board found Students A and B responsible for violating regulation 1 and 13C. Students A and B were found not responsible for violating regulation 13B.  Students A and B were found responsible for violating regulation 15. The board sanctioned the students with a disciplinary warning.

In a simplified hearing, the board considered allegations that students violated Regulations l, 13b, 13C and 15 of the Wesleyan University Code of Non-Academic Conduct.  The students were found responsible for all four violations and sanctioned with a disciplinary warning.

In a simplified hearing, the board considered allegations that Students A, B, C, D, E, F, G and H violated regulations 1, 13b. Students A, B, and C were also alleged to have violated regulation 13c.  All students were found not responsible for violating regulation 1. Students A, B, C, D, E, and F plead responsible for consuming alcohol, and found responsible for violating regulation 13b. Students G and H were found not responsible for violating regulation 13c. Finally, students A, B, and C were found responsible for violating regulation 13c.  All students who were found responsible were sanctioned with a disciplinary warning.

In a simplified hearing, the board considered allegations that a student violated Regulation 1, 4 and 15 of the Wesleyan University Code of Non-Academic Conduct.  The student was found not responsible for violating Regulation 1 and 4, but found responsible for violating Regulation 15.  The student was sanctioned with a disciplinary warning.

REGULATION 4 – [Property] The unauthorized use, or the abuse, destruction, or theft of University property or the property of any of its members, guests, or neighbors is prohibited.  This includes but is not limited to all tunnels, roofs, and areas under construction.  This regulation prohibits the unauthorized appropriation or “borrowing” of common property for personal use.

In a Simplified Hearing, the Board considered allegations that a student violated Regulation 4 and 8.  The student was found responsible for violating Regulation 4, but not responsible for violating Regulation 8. The student was sanctioned with a disciplinary warning and required to return the item to its proper place.

In a joint administrative hearing, the board considered allegations that Students A, B, C and D violated Regulations 4 of the Wesleyan University Code of Non-Academic Conduct.  The students were sanctioned with a disciplinary warning.

In a simplified hearing, the board considered allegations that Students A, B, C and D violated Regulation 4 and 14 of the Wesleyan University Code of Non-Academic Conduct.  Students C and D claimed to not have their belongings on the balcony.  Student A claimed that there was no damage to university-owned furniture on the balcony.  Due to the lack of photo evidence, the board could not reach a resolution.

REGULATION 8 – [Fire Protection Systems] Tampering with fire extinguishers, fire alarm boxes, or smoke or heat detectors anywhere on University property is prohibited.

In a simplified hearing, the Board considered allegations Students A, B, C and D violated Regulation 8 and Regulation 4 of the Wesleyan University Code of Non-Academic Conduct.   The Board found both students C and D responsible for violating Regulation 8 and not responsible for Regulation 4.  The Board found Students A and B not responsible for Regulation 8 or Regulation 4.  The students responsible were sanctioned with a disciplinary warning.

In a simplified hearing, the Board considered allegations that a student violated Regulation 8 of the Wesleyan University Code of Non-Academic Conduct.  The Board found the student responsible for violating Regulation 8 and issued a disciplinary warning.

In a simplified hearing, the board considered allegations that a student violated regulation 8 of the Wesleyan University Code of Non-Academic Conduct.   The Board found the student responsible for violating the regulation and sanctioned a disciplinary warning.

REGULATION 9B – [Storing Flammable Material] Canned heat (Sterno brand cooking fuel), flammable liquids, charcoal grills, and other open-flame devices, except in areas such as kitchens or laboratories that are specifically designed for their use.  Likewise, candles and flammable decorations are also prohibited. 

In a simplified hearing, the board considered allegations that Students A and B violated Regulations 9B and Regulation 15 of the Wesleyan University Code of Non-Academic Conduct.  Student A was found responsible for violating regulation 9B, but not responsible for Regulation 15.  The Board issued a disciplinary warning.   The Board found Student B not responsible for either violation.

In a simplified hearing, the Board considered allegations that a student violated regulations 9b, 13b and 15 of the code of non-academic conduct. The student was found responsible for all violations and was issued a disciplinary warning.

In a simplified hearing, the board considered allegations that Students A, B, C and D violated regulations 9B, regulation 9D and regulation 15 of the Wesleyan University Code of Non-Academic Conduct. After careful consideration, the board found student A responsible for violating regulations 9B and 9D. Student B was found responsible for violating all three regulations. Finally, both students C and D were found responsible for violating regulations 9B, and 15.  The Board sanctioned Students A, C and D with a disciplinary warning and Student B was sanctioned with a disciplinary probation for one year.

In a simplified hearing, the board considered allegations that Students (A, B and C) violated regulation 9b and regulation 15 of the Wesleyan University Code of Non-Academic Conduct. The Board found Student A responsible for violating both regulations and sanctioned a disciplinary warning.  The Board found students B and C not responsible. 

REGULATION 9c – [Cooking/Heating Devices] Cooking and heating devices are prohibited in all student residential facilities (except kitchens)

In a simplified hearing, the board considered allegations that Students A and B violated regulation 9C and Regulation15 of the Wesleyan University Code of Non-Academic Conduct.  The board found both students responsible for both violations and were given a disciplinary warning.

REGULATION 9D – [Certain Decorative Items] e.g., candles, halogen lamps, tapestries are also prohibited in student residencies.

In a Simplified Hearing, the Board considered allegations that students violated Regulation 9D of the Wesleyan University Code of Non-Academic Conduct.  The Board found the students not responsible for violating Regulation 9D Decorative Items.

In a simplified hearing, the Board considered allegations that a Student violated regulation 9b of the code of non-academic contact. The student was found responsible for regulation 9b, as photo evidence shows multiple candles in the student's room. The Board sanctioned the student with a disciplinary warning. 

In a simplified hearing the board considered allegations that a Student written violated regulation 9d of the Wesleyan University Code of Non-Academic Conduct.  The student was found responsible for violating 9d and was sanctioned with a disciplinary warning. 

In a Simplified Hearing, the Board considered allegations that Students A, B, C and D violated regulations 9d, Regulation 13a and Regulation 15b of the Wesleyan University Code of Non-Academic Conduct. The Board found students A, B, C, and D responsible for violating Regulation 9d and regulation 13a. The Board found all students  responsible for all violations.  Students A, B and C were sanctioned with a disciplinary warning and Student D was sanctioned with a disciplinary probation due to repeat offenses. 

In a simplified hearing, the Board considered allegations that Students A, B, C, D, and E violated regulations 9D and 15 of the Wesleyan  University Code of Non-Academic Conduct.   The Board found all the students responsible for violating Regulation 9D, but not responsible for violating Regulation 15.  The student had cardboard boxes blocking the lights in their home, which is considered a fire hazard, so they were found responsible for violating regulation 9D. The students were found not responsible for violating regulation 15.  The Board sanctioned the students with a disciplinary warning and a warning was also issued from the Middletown Fire Department.  

REGULATION 13A [Drugs and Alcohol] The possession, use, manufacture, distribution, or dispensing of illegal drugs or controlled substances by any member of the Wesleyan community. 

In a simplified hearing, the board considered allegations that a student violated regulation 13a of the Wesleyan University Code of Non-Academic Conduct.  The student was found responsible and sanctioned with a Disciplinary Warning.

In a simplified hearing the board considered allegations that a student violated Regulation 13A and Regulation 15 of the Wesleyan University Code of Non-Academic Conduct. The student was found responsible for violating both these violations and was sanctioned with a Disciplinary Warning.

In a simplified hearing, the board considered allegations that a student violated regulation 13A and regulation 15 of the Wesleyan University Code of Non-academic Conduct.  After careful consideration, the board found the student not responsible for both violations.

In a simplified hearing, the Board considered allegations that students A and B violated Regulation 13a and Regulation 15 and Student B the additional violation of 9D of the Wesleyan University Code of Non-academic Conduct.   The Board found Student A responsible for Regulation 13a and Regulation 15. Student B was found responsible for Regulation 9D and was found not responsible for Regulation 13a and Regulation 15.  Student A was placed on Disciplinary Probation due to their total of points and Student B was given a Disciplinary Warning.

During a simplified hearing the board considered allegations that a student violated Regulation 13A, 13B and 14 of the Wesleyan University Code of Non-academic conduct. The student was found responsible Regulation 13a and 13b, but not responsible for Regulation 14.  The Board sanctioned the student with a Disciplinary Warning and an alcohol educational requirement.

REGULATION 13B [Drugs and Alcohol] Underage possession or consumption of alcohol anywhere on University property or at University-sponsored events.

In a simplified hearing, the Board considered allegations that a student violated regulation 13 of the Wesleyan University Code of Non-Academic Conduct.  Because the student has been transported before, the Board sanctioned the student with a deferred suspension and recommends support from Wesleyan's WesWell and online alcohol EDU. 

In a Simplified hearing, the board considered allegations that Student A, B, C, D, E, and F violated Section II, Regulation 13b, 13c, and regulation 1 of the Wesleyan University Code of Non-Academic Conduct. The Board found all students not responsible for any of the violations. 

In a simplified hearing, the Board considered allegations that 17 students violated regulation 13B of the Wesleyan University Code of Non-Academic Conduct. The board found these 17 students responsible.  The board sanctioned 16 students with a Disciplinary Warning and 1 student with a Disciplinary Probation due to accumulated points.  

REGULATION 14 [Failure to Comply] Members of the community are expected to comply with reasonable requests made by University personnel acting within the capacity of their responsibilities, including requests for adequate identification. 

In a simplified hearing, the board considered allegations that a student violated the (ESA) Emotional Support Animal agreement, and thus had violated Section 14 of the Wesleyan University Code of Non-Academic Conduct. The board found the student responsible for the violation. Furthermore, the board recommends that the student be able to keep the ESA on campus, but be required to have regular meetings with a member of the Reslife staff regarding the training of the dog.

In a simplified hearing, the board considered allegations that a student violated regulation 14 and 15 of the Wesleyan University Code of Non-academic Conduct. The Board found the student responsible for violating Regulation 15 and not responsible for violating regulation 14. The student was sanctioned with a Disciplinary Warning.

In a simplified hearing, the Board considered allegations that Students A, B, C, D and E violated Regulation 14 of the Wesleyan University Code of Non-academic Conduct.  The Board found students A, B, and C responsible but Students D and E not responsible.  Students A, B and C were sanctioned with a Disciplinary Warning. 

In a simplified hearing, the Board considered allegations that a Student violated Regulation 14 and 15 of the Wesleyan University Code of Non-academic Conduct (an unauthorized air conditioner). The Board sanctioned the student with a Disciplinary Warning and the student was given a deadline to remove the unit.

In a simplified hearing, the board considered allegations that Student A violated Section II, Regulation 14  and 15 of the Wesleyan University Code of Non-Academic Conduct. The board also considered allegations that Student B violated Section II, Regulations 5 and 14, and 15. The Board found that student A was responsible for violating regulation 14 and not responsible for violating the residency policy. The board found that student B was responsible for violating regulations 5 and 14 as well as the residency policy. The board recommended students A and B be sanctioned with a disciplinary warning.

REGULATION 15 [Department Regulations] Members of the community are expected to abide by duly established and promulgated non-academic regulations.  These include, but are not limited to, policies for Residential Life, Public Safety, Information Techology, and all the other policies. A) Social Event Registration; B)Unregistered Guest; C)Smoking in Residence Hall; D) Quiet Street Noise Violation; E) Physical Plant/Restricted Items

In a simplified hearing the board considered allegations that a student violated regulation 15 [Chalking] of the Wesleyan University Code of Non-Academic Conduct. The student was found responsible and sanctioned with a Disciplinary Warning. 

In a Simplified Hearing, the board considered allegations that Students A, B, C and D violated, Regulation 15 (Social Event or Woodframe Registration Policy) of the Code of Non-Academic Conduct. The students were found responsible. The students were given the appropriate sanctions.

In a simplified hearing the board considered allegations that Students A, B and C violated Regulation 15, 9B and 13b of the Wesleyan University Code of Non-Academic Conduct.  The board found that both students A and B were not responsible for any of the charges.  However, Student C was found responsible for Regulation 9b and 13b, but not Regulation 15.  Student C received a disciplinary warning.

In a simplified hearing the board considered allegations that a students A and B violated Regulation 15 of the Wesleyan University Code of Non-Academic Conduct.  As both students live on a quiet street and were over capacity, the board found both students responsible for violating regulation 15 and sanctioned a Disciplinary Warning. 

In a simplified hearing, the board considered allegations that a Student violated Regulation 15 of the Wesleyan University Code of Non-Academic Conduct.  Considering that the student was not present at the scene, the student was found not responsible for either allegation.

In a Simplified Hearing, the board considered allegations that Students A, B, C, and D were to have violated Regulation 15 [Social Event Registration] of the Wesleyan University Code of Non-Academic Conduct. The Board found the students not-responsible for both alleged violations.

In a simplified hearing, the board considered allegations Students A, B, C and D of the Wesleyan University Code of Non-Academic Conduct.  Students A, B, and C were found responsible.  Student D was found not responsible. Students A, B and C were sanctioned with a Disciplinary Warning.

In a simplified hearing, the Board considered allegations that a student violated Regulation 15 [Woodframe Policy Hosting Registration] of the Wesleyan University Code of Non-Academic Conduct.  The board finds the student responsible and the student is sanctioned with a Disciplinary Warning and an online educational requirement.
